1. Scope and provider
These Terms & Conditions govern the use of TestAS Generator (the “Service”), an online platform for practicing and simulating the TestAS Core Module, operated by Kamila Abovian, Hahnenstraße 7, 50354 Hürth, Germany (“we”, “us”).
2. Paddle as Merchant of Record
All paid orders on this website are sold by Paddle.com Market Ltd (30 Old Bailey, London EC4M 7AU, United Kingdom, company no. 8172165), acting as our authorized reseller and Merchant of Record. This means Paddle, not us, is the seller of record for your purchase: Paddle collects payment, determines and collects applicable VAT or sales tax, issues your invoice/receipt, and is your point of contact for billing questions, refunds initiated through their system, and chargebacks. We remain responsible for providing the Service itself. Paddle's own terms of use, available at paddle.com/legal/buyer-terms, apply in addition to these Terms for the payment transaction itself.
3. The Service
The Service provides practice exercises and full-length simulations for the TestAS Core Module. A free trial is available to eligible new users; paid plans (Practice or Full Access, in 1-month or 3-month durations) unlock additional content and functionality as described on our pricing page. We do not guarantee any specific exam outcome or score.
4. Contract formation and payment model
All plans are one-time payments for a fixed access period — we do not offer auto-renewing subscriptions. A contract is formed once you complete checkout through Paddle and payment is confirmed. Access to the purchased plan is activated automatically upon confirmed payment, runs for exactly the fixed duration purchased, and then ends on its own — you will not be charged again unless you actively make a new purchase.
5. Prices and payment
All prices shown are gross prices (inclusive of any applicable VAT, per PAngV) in the currency displayed at checkout. Payment is processed exclusively through Paddle using the payment methods it offers, as a single one-time charge per purchase — never a recurring or automatically-renewing charge.
6. Right of withdrawal
As a consumer, you have a statutory right of withdrawal for purchases of digital content. Details, including the circumstances under which this right ends early, are set out in our Right of Withdrawal.
7. Cancellation / termination
Because every plan is a one-time, fixed-period purchase with no auto-renewal, there is nothing to cancel in the ongoing-contract sense — your plan simply ends on its own at the end of the period you paid for. See our cancellation page for details.
8. Liability
We are liable without limitation for damages resulting from injury to life, body, or health, and for intent or gross negligence. For slightly negligent breaches of a material contractual obligation (Kardinalpflicht), our liability is limited to the foreseeable damage typical for this type of contract. Further liability is excluded.
9. Changes to these Terms
We may update these Terms to reflect changes to the Service or legal requirements. Material changes will be communicated to registered users in advance by email or in-app notice.
10. Governing law and jurisdiction
These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of residence remain unaffected.
11. Severability
Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
